Gift in Contemplation of Death (Donatio Mortis Causa)
A gift made by a person who believes they are about to die, conditional on their death, taking effect on death.
A donatio mortis causa requires three elements: the gift must be made in contemplation of imminent death; it must be conditional on death (not absolute at the time); and the donor must deliver dominion over the subject matter.
These gifts are rare and often disputed. A properly drafted Will is a far safer way to make a death-time gift.
