Letter of Wishes
A non-binding document accompanying a Will or trust, expressing the person's wishes for guidance.
A letter of wishes sits alongside a Will or trust. It is not legally binding, which is its strength: trustees and executors can be guided by the letter without being bound by it, allowing flexibility as circumstances change.
Letters of wishes are particularly useful for Discretionary Trusts, where they explain the testator's thinking on how trustees should exercise their discretion.
