The person who makes a Will. The female form 'testatrix' is now rarely used.
A testator must be 18 or over (with limited exceptions for serving members of the armed forces) and must have testamentary capacity at the time the Will is made.
Testamentary capacity means understanding the nature of making a Will, the extent of the estate, and the claims of those who might expect to benefit. Capacity is decision-specific; a testator may lack capacity for some matters and not others.
Will
A legal document setting out who inherits an estate when the person who made it dies, who acts as executors, and (where relevant) who looks after dependants.
Executor
The person named in a Will to administer the estate after the testator's death, including collecting assets, paying debts, and distributing the residue to beneficiaries.
Beneficiary
A person or organisation named in a Will or trust to receive assets, income, or a benefit under the document.
