A Health and Welfare LPA lets your chosen attorneys make decisions about your medical care, where you live, who can visit you, and (if you choose) whether to give or refuse consent to life-sustaining treatment. It can only be used if you lose capacity to make these decisions yourself.
What a Health and Welfare LPA can do.
- Make decisions about medical treatment, including consent or refusal
- Choose where you live, including residential or nursing care
- Decide on day-to-day matters such as diet, dress and routine
- Decide who can visit you and who cannot
- Liaise with doctors, social workers and care providers on your behalf
- Make decisions on life-sustaining treatment, but only if you specifically grant that authority
Single Health and Welfare LPA from £300 to £1,200 including VAT per LPA. Discounts apply for packages. The OPG registration fee (currently £92) is payable separately.
Common questions.
Only if you specifically grant that authority in the LPA. Without that, an attorney can make most healthcare decisions but not decisions about life-sustaining treatment. We talk this through carefully during drafting.
Only when you have lost capacity to make the decision in question. Capacity is decision-specific; you may have capacity for some decisions and not others, and the LPA only applies where you have lost capacity for the relevant decision.
