Court of Protection
The court that makes decisions for people who lack mental capacity, including appointing Deputies where no LPA is in place.
The Court of Protection deals with the property, financial affairs, and personal welfare of people who lack mental capacity to make decisions themselves. Where no LPA was put in place, families typically apply to the Court for the appointment of a Deputy.
Deputy applications take months and cost more than putting an LPA in place. Deputies are supervised by the Office of the Public Guardian for life, with annual reporting requirements.
